Terms and Conditions for Hire of Elle TENS Machine from One For Mum.

This agreement sets out the terms and conditions under which the Elle TENS machine ("the Machine") is hired to the Hirer.

1. Definitions

• "Hirer" refers to the individual hiring the Elle TENS machine.
• "Owner" refers to One For Mum, the owner of the Elle TENS machine.

2. Hire Period

• The hire period begins on the date the Elle TENS machine is collected or delivered to the Hirer and continues for the duration specified in the agreement.
• The Hirer agrees to return the Machine by the agreed date and time. Failure to do so may result in additional charges.

3. Condition of Machine

• The Machine is hired in good working condition and will be delivered with all necessary accessories (electrode pads, batteries, instructions).
• The Hirer agrees to return the Machine in the same condition, fair wear and tear excepted.

4. Responsibility of Hirer

• The Hirer is responsible for the safekeeping and proper use of the Machine during the hire period.
• The Machine should only be used for its intended purpose as described in the user manual provided.
• The Hirer agrees not to tamper with or attempt to repair the Machine.
• The customer will have discussed the use of an Elle TENS machine with their health care provider in charge of their prenatal care and received approval.

5. Payment and Charges

• The hire fee is payable in advance of the hire period.
• A refundable security deposit may be required and will be returned to the Hirer upon satisfactory return of the Machine.
• The Hirer agrees to pay a $200 fee for any damage to or theft/loss of the Machine during the hire period.

6. Delivery and Return

• The Machine can be collected from One For Mum or delivered to the Hirer at an additional cost.
• The Machine will be sent out to arrive on or before the Customer’s due date. The Machine unit must be returned to One For Mum on or by the last day of the hire period (Unless prior arrangements are made and agreed upon)
• Late return may incur additional fees.

7. Liability

• The Owner shall not be liable for any injury, loss, or damage caused by the use of the Machine, except where such injury, loss, or damage arises from the negligence or wilful misconduct of the Owner.
• The Hirer agrees to indemnify the Owner against any claims arising from the use or misuse of the Machine during the hire period.

8. Cancellation

• The Hirer may cancel the hire agreement by giving 3 Day notice prior to the hire period. A cancellation fee may apply.
• If the machine has already been picked up by courier service a cancellation will not be accepted and full hire fees with apply.

9. Entire Agreement

• This agreement constitutes the entire agreement between the parties and supersedes all prior agreements, understandings, negotiations, and discussions, whether oral or written.
